A 15-Year-Old, an Unwanted Pregnancy, and a Supreme Court Verdict That Changed Everything

A deeply sensitive case came before the Supreme Court of India involving a 15-year-old girl who was over seven months pregnant. The minor had approached the Court seeking permission to terminate the pregnancy, which was described as unwanted.

According to the Court’s observations, the girl is only 15 years old which means she is still legally a child under Indian law.

At such a young age, she is expected to be in school. Instead, she was facing the physical and mental burden of a late-stage pregnancy.

The Court also noted that she had attempted to end her life twice. This reflects the emotional distress she was experiencing.

What the Supreme Court said

A bench of Justices BV Nagarathna and Ujjal Bhuyan allowed the termination, making it clear that forcing a minor to continue such a pregnancy could lead to irreversible harm.

The Court highlighted concerns that can affect the minor, including education and future opportunities of the girl child. In some cases, social stigma leads to isolation and mental trauma. All these may have long-term consequences on physical health.

The Supreme Court stated that no court can compel a woman, especially a minor, to continue an unwanted pregnancy. It reiterated that reproductive autonomy is part of the fundamental right to life and personal liberty under Article 21 of the Constitution.

The judges also made it clear that a woman’s decision regarding her own body holds the highest importance in such cases.

It was observed that forcing continuation of an unwanted pregnancy may push individuals toward hidden abortions, which can put the woman’s life at risk.

Instead, the legal system must ensure safe and lawful options.
