Is India Finally Getting Paternity Leave? Supreme Court’s Big Remark

Mothers are considered the primary caregivers, and this is the reason why, for decades, conversations around childcare and maternity benefits in the workplace have revolved primarily around mothers.

However, the Supreme Court of India now wishes to shift the focus towards fathers too by highlighting the need for paternity leave.

The observation was made during a court proceeding related to maternity benefits for adoptive mothers adopting children above 3 months of age. The court remarked that a child needs both parents and urged the government to reconsider provisions for paternity leave.

Why Is This Important?

In India, there is no legal provision for paternity leave right now, especially in the private sector. Some government employees and corporate workers may have limited paternity leave options, but only for a week or so.

This somehow limits the valuable time their fathers get to spend with their babies and places immense pressure on the mothers. This can be challenging during the postpartum phase when they are still recovering physically and emotionally.

Also, we cannot simply ignore the impact on the baby, as the early weeks are very important for bonding and building social connections. The presence and involvement of both parents are crucial during this phase.

A Bench of Justices J.B. Pardiwala and R. Mahadevan observed that paternity leave allows fathers to meaningfully participate in the early stages of a child’s life and development.

Modern Parenting Requires Modern Solutions

Parenting today is quite different from how it used to be earlier. Decades ago, we used to live in joint families, and new parents had the support of grandparents, uncles, and aunts while raising their babies. As such, the responsibility of raising the child was not solely on the shoulders of one person, and it was distributed among the family.

However, in a nuclear family set-up, the responsibility largely falls on the shoulders of the mother, who has to take care of the household, her health, and care for the newborn.

In such situations, many couples have to either invite their parents to stay with them or travel back to their hometowns for support. This support system helped reduce the responsibilities on the shoulders of the parents, and as such, there was rarely any need for paternity leave earlier.

While the Supreme Court has urged the government to consider provisions for paternity leave, it cannot be said exactly when such a policy will be introduced. The fact that the issue is now being discussed at such a high level is itself important, and we hope that fathers in India soon receive better support through paternity leave provisions.
